Правові механізми захисту прав суб’єктів господарювання як фактор економічної стабільності та інвестиційної привабливості держави

Abstract

Здійснено комплексне теоретичне обґрунтування ролі правових механізмів захисту суб’єктів господарювання як фундаментального детермінанта стимулювання інвестиційної активності та забезпечення стабільності ринкового середовища. Досліджено трансформацію правового регулювання підприємництва в умовах глобалізаційних процесів та економічної інтеграції. Особливу увагу приділено критичній значущості предиктивності правового поля у сферах договірних відносин, захисту прав інтелектуальної власності та підтримки добросовісної конкуренції для формування інституційної довіри інвесторів. Дослідження підтверджує кореляцію між рівнем захисту прав підприємців та обсягом іноземних інвестицій. Визначено роль держави у забезпеченні справедливості й прозорості правозастосування. На основі системного та юридичного аналізу уточнено зміст гарантій для бізнесу та запропоновано рекомендації щодо його взаємодії з державними органами. Наукова новизна полягає у систем- ному підході до правового захисту як чинника міжнародної конкуренто-спроможності національної економіки.The article presents a comprehensive theoretical substantiation of the role of legal mechanisms for the protection of business entities as a fundamental determinant of stimulating investment activity and ensuring the stability of the market environment. The transformation of legal regulation of entrepreneurship in the context of globalization processes and economic integration is studied. Particular attention is paid to the critical importance of the predictiveness of the legal field in the areas of contractual relations, protection of intellectual property rights and support of fair competition for the formation of institutional trust of investors. The study confirms the correlation between the level of protection of the rights of entrepreneurs and the volume of foreign investment. The role of the state in ensuring justice and transparency of law enforcement is determined. On the basis of systemic and legal analysis, the content of guarantees for business was clarified and recommendations for its interaction with state bodies were proposed. The scientific novelty lies in the systematic approach to legal protection as a factor in the international competitiveness of the national economy.
