Abstract
У статті розглянуто особливості функціонування ринку нерухомості України в умовах воєнного стану та роль малого і середнього підприємництва у збереженні економічної активності територій. Підкреслено, що ринок нерухомості є просторово організованою системою, у межах якої здійснюється розподіл і використання майнових активів, необхідних для забезпечення життєдіяльності населення, розміщення виробництва і розвитку комерційної інфраструктури. Обґрунтовано, що вплив повномасштабної війни призвів до суттєвого переформатування попиту і пропозиції на ринку нерухомості, зміни логістики розміщення бізнесу, посилення регіональної диференціації та зростання потреби в оперативній мобільності просторових ресурсів. Встановлено, що МСП, як найбільш гнучка група економічних агентів, забезпечують підтримання підприємницької активності, однак водночас є надзвичайно вразливими до ризиків втрати майна, зростання вартості оренди, порушення інвестиційних відносин і нестабільності правового середовища. Проаналізовано основні нормативно-правові акти, що регулюють орендні, будівельні, компенсаційні та реєстраційні процедури в умовах воєнного стану, а також інструменти державної підтримки МСП, зокрема пільгові програми кредитування, механізми релокації підприємств, компенсаційні інструменти за знищене або пошкоджене майно та спрощені процедури введення об’єктів в експлуатацію. Показано, що важливим напрямом забезпечення стабільності ринку є цифровізація реєстраційних дій і відновлення доступу до державних реєстрів, що сприяє прозорості транзакцій і гарантіям прав власності. Окрему увагу приділено ролі територіальних громад як базових суб’єктів просторової політики, які створюють інфраструктурні умови для розміщення бізнесу, розвиток бізнес-парків, хабів і локацій для релокованих підприємств. Доведено, що ефективна підтримка МСП у сфері нерухомості має бути багаторівневою та диференційованою залежно від типу територій, а забезпечення доступу до майнових ресурсів є основною умовою відновлення економіки та підвищення стійкості регіонів у повоєнний період.
The article examines the peculiarities of the real estate market's functioning in Ukraine under martial law and the role of small and medium-sized enterprises in maintaining economic activity in the affected territories. It is emphasized that the real estate market is a spatially organized system within which the distribution and use of property assets necessary to ensure the livelihoods of the population, the location of production, and the development of commercial infrastructure are carried out. It is argued that the impact of full-scale war has led to a significant reformation of supply and demand in the real estate market, changes in business location logistics, increased regional differentiation, and a growing need for operational mobility of spatial resources. It has been established that SMEs, as the most flexible group of economic agents, play a crucial role in maintaining entrepreneurial activity; however, they are also highly vulnerableto risks such as property loss, rising rental costs, disruption of investment relations, and instability in the legal environment. Key regulatory and legal acts governing rental, construction, compensation, and registration procedures under martial law, as well as instruments of state support for SMEs, in particular, preferential lending programs, mechanisms for relocating enterprises, compensation instruments for destroyed or damaged property, and simplified proceduresfor commissioning facilities. It is demonstrated that a crucial step in ensuring market stability is the digitization of registration processes and the restoration of access to state registers, which enhances transaction transparency and ensures the protection of property rights. Particular attention is paid to the role of local communities as the primary actors in spatial policy, which creates the infrastructure conditions for business location, the development of business parks, hubs, and places for relocated enterprises. It has been proven that adequate support for SMEs in the real estate sector must be multi-level and differentiated depending on the type of territory, and that ensuring access to property resources is a prerequisite for economic recovery and increased regional resilience inthe post-war period.
