Abstract
The article provides a thorough theoretical and legal study of the mechanisms for appealing decisions of Military Medical Commissions (MMCs) under the legal regime of martial law in Ukraine. The relevance of the topic is determined by the need to balance the constitutional duty of citizens to defend the Motherland with the guarantees of protecting human rights during mobilization measures. Based on the analysis of the Regulation on Military Medical Examination in the Armed Forces of Ukraine (Order No. 402), the hierarchical structure of the MMC system is detailed, the competence of staff and non-staff commissions is delineated, and their role as subjects of public authority is determined. Special attention is paid to the analysis of the latest judicial practice of the Supreme Court and appellate administrative courts for the 2025–2026 period. The study proves that the judiciary has finally formed an approach regarding the mandatory nature of the pre-trial (administrative) appeal procedure as a necessary "procedural filter." The author substantiates the thesis that appealing decisions of lower-level MMCs directly to the court without a prior review of this decision by a higher-level staff MMC (regional MMCs or the CMMC) is premature, which constitutes independent grounds for dismissing the claim. The study examines in detail the limits of judicial interference in the discretionary powers of military medical experts. It has been established that the administrative court, not being a specialized medical institution, is limited only to checking the procedural legality of the decision-making process. At the same time, based on the analysis of the Supreme Court's 2025 practice, the requirement for high quality and motivation of individual acts is emphasized. It is proved that formal "reply letters" from staff MMCs without proper justification are unlawful, as they violate the person's right to a fair administrative procedure. The doctrine of the "irreversibility of mobilization" is critically analyzed, according to which procedural violations at the stage of passing the MMC do not entail automatic discharge from military service. The author concludes that there is a legal conflict between the interests of state security and the effectiveness of legal remedies for the individual. Proposals are formulated to improve the current legislation in terms of detailing the terms of control examinations and increasing responsibility for improper motivation of expert conclusions.
