Визначення понять «Інтелектуальна власність» і «Право інтелектуальної власності»

Abstract

У статті досліджено важливість вивчення питань, пов’язаних з розвитком інтелектуальної власності в Україні, проаналізовано ключові аспекти цих термінів. Інтелектуальна власність — це сукупність правових та економічних механізмів захисту обʼєктів інтелектуальної діяльності, таких як авторські права, патенти, торговельні марки тощо. Право інтелектуальної власності — це система нормативно-правових актів і правових відносин, що регулюють користування, захист та охорону обʼєктів інтелектуальної власності. Наведено визначення цих понять, визначено їх роль у сучасній економіці та правовій системі, а також особливості застосування та захисту прав, доведено необхідність застосування цих понять для надання освітніх послуг здобувачам вищих навчальних закладів і для практичного застосування в оформленні охоронних документів. The article explores the importance of studying issues related to the development of intellectual property in Ukraine. Namely, the information is focused on analyzing key aspects of these terms. Intellectual property is a set of legal and economic mechanisms for protecting objects of intellectual activity, such as copyrights, patents, trademarks, and others. Intellectual property law is a system of regulatory legal acts and legal relations that regulate the use, protection and safeguarding of intellectual property objects. In scientific and higher education institutions, an important function of intellectual property is to create a culture of academic integrity, stimulate interdisciplinary research, and transfer technology to the real sector of the economy. Registration of intellectual property rights contributes to the growth of the academic ranking of institutions, the development of startups, and the expansion of cooperation with industrial partners. Intellectual property covers a range of objects related to the results of creative activity that do not have a physical form, but have economic and social value. Intellectual property is an important component of the modern information society and serves as the basis for innovation, technological development and business The paper examines the definition of these concepts, their role in the modern economy and legal system, as well as the features of the application and protection of rights. The need to apply these concepts to provide educational services to applicants to higher education institutions and for practical application in the preparation of security documents.
