Особливості сучасних визначень змісту категорії «забезпечення й захист прав і свобод людини і громадянина»

Abstract

У статті розглянуто поняття забезпечення й захисту прав та свобод людини і громадянина в контексті запропонованих прагматично-правового, системно-правового та функціонально-правового підходів. На основі розглянутих матеріалів розроблено авторське його визначення, яке б більш повніше відповідало потребам суспільства. The article is based on trends in the modern development of the concept of human rights. The author reviewed the concept of security and protection of the rights and freedoms of man and citizen (human rights) in the context of the proposed pragmatical-legal, legal-systemic and the functional-legal approaches. On the basis of these materials was developed author's definition of security and protection of the rights and freedoms of man and citizen, that may meet the needs of modern society.
